Terms of Trade

GoldMarc B.V. is a Netherlands-registered precious metals dealer trading under Dutch law. Our registered address is Bargelaan 200, 2333 CW Leiden. We buy and sell authentic Krugerrand coins in gold and silver, and purchase gold from private sellers across the Netherlands and EU.

We are registered with the Dutch Chamber of Commerce (KvK: 99855135), hold a valid Dutch VAT number (BTW: NL005414790B54), and operate as a registered precious metals dealer under the Wwft, supervised by the Dienst Financieel-Economische Integriteit (DFEI) under the Dutch Ministry of Finance.

Throughout these Terms of Trade the following words carry the meanings set out below.

• "You" or "the Buyer" — the individual or organisation placing an order with GoldMarc B.V.
• "We", "Us", or "GoldMarc" — GoldMarc B.V.
• "Order" — a purchase request submitted through goldmarc.nl or by any other agreed means.
• "Order Reference" — the unique transaction identifier generated at checkout, formatted GM-YYYYMMDD-XXXX.
• "Confirmation" — our written acceptance of your Order by email.
• "Goods" — the gold or silver Krugerrand coins forming the subject of your Order.
• "Spot Rate" — the live LBMA gold or silver price at any given moment.
• "Price Lock" — the guaranteed price held for 1 hour from the moment your Order Reference is generated.

How our prices work

All prices on goldmarc.nl are calculated in real time as a percentage margin over the live LBMA spot rate, which updates every 60 seconds during market hours. Because precious metal prices move continuously, the price on any product page is indicative until you complete checkout.

Your Price Lock

Once you complete checkout and receive your Order Reference, your price is locked for 1 hour. This gives you time to complete your bank transfer at the confirmed rate. If your payment reaches us after the 1-hour window has closed, we reserve the right to recalculate your order at the rate prevailing at the time of receipt. We will contact you with the revised figure. If the revised price is not acceptable to you, we will return any funds received in full within 5 business days.

VAT

Gold Krugerrand coins are classified as investment gold under EU VAT Directive Article 344 and are sold free of VAT throughout the EU. Silver Krugerrand coins are subject to 21% Dutch BTW, shown separately and included in the total at checkout. Delivery costs are stated separately.

Pricing errors

In the unlikely event that a price is displayed incorrectly due to a technical error, we reserve the right to cancel the order and refund any payment received. We will notify you promptly if this occurs.

How orders work

You place an order by completing the checkout process on goldmarc.nl. A binding purchase agreement is formed only when we send you a written Confirmation by email. Until that Confirmation is sent, no agreement exists.

When we may decline an order

We reserve the right to decline or cancel any order, including after initial confirmation, in the following circumstances: payment is not received within the 1-hour Price Lock window; the market moves materially between order and payment; we are unable to complete identity verification under our Wwft obligations; goods are no longer available; or we have reasonable grounds to suspect fraudulent activity. In each case we will notify you promptly and refund any payment received within 5 business days.

Verbal promises

No verbal or informal promise given by any representative of GoldMarc B.V. creates a binding obligation unless confirmed in writing.

Method

All payments must be made in full and in advance by SEPA bank transfer in Euros. We do not accept payment by credit card, cryptocurrency, or any other method.

Our payment details

Your payment reference

When making your transfer, you must use your Order Reference and full name exactly as shown in your Confirmation — for example: GM-20260605-4821 — Jan de Vries. Transfers received without a correct reference may not be matched to your order. GoldMarc B.V. accepts no liability for delays caused by incorrect or missing payment references.

Cash payments

Cash payments are accepted only up to a maximum of €3,000 per transaction in accordance with Dutch law effective 1 January 2026. We reserve the right to refuse cash at any time without giving reasons. Cash above €3,000 is prohibited by law and will not be accepted under any circumstances.

When we proceed

We will only prepare your order for dispatch once full cleared payment has been received and, where required, identity verification has been completed.

Dispatch

We dispatch all orders after full payment is confirmed and any required identity verification is complete. All stated delivery times are estimates and cannot be guaranteed.

Delivery options and costs

• Netherlands, Belgium, Luxembourg, Germany: Insured courier, €25.00 per order, estimated 3–5 business days.
• Collection in person: Free — by appointment only. Contact sales@goldmarc.nl to arrange.
• All other countries: Please contact us at sales@goldmarc.nl for a delivery quote.

Insurance and risk

All shipments are fully insured at replacement value from the moment they leave our hands until delivery. Risk transfers to you upon delivery.

Failed delivery

If you are unavailable to receive your delivery and the goods are returned to us, re-delivery costs will be charged to you.

High-value orders

For orders with a cumulative value above €10,000, identity verification must be completed before dispatch. We will contact you to arrange this.

Binding agreement

By completing checkout you enter into a binding purchase agreement. Orders cannot be cancelled or amended once placed.

Exclusion of withdrawal right

In accordance with Article 6:230p(e) of the Dutch Civil Code, the statutory 14-day right of withdrawal does not apply to purchases of goods whose price depends on fluctuations in the financial markets beyond our control. This applies to all products we sell, including gold Krugerrand coins in all sizes and years, silver Krugerrand coins in all years, and numismatic and collector coins. You explicitly acknowledge and agree to this when you tick the consent checkbox at checkout.

Price movement after purchase

Market price movements between the time of your order and delivery do not entitle you to cancel, amend, or seek compensation.

Our regulatory position

GoldMarc B.V. is a Wwft-registered precious metals dealer — the Wwft being the Wet ter voorkoming van witwassen en financieren van terrorisme, the Dutch Anti-Money Laundering and Anti-Terrorist Financing Act. We are supervised by the Dienst Financieel-Economische Integriteit (DFEI) under the Dutch Ministry of Finance.

Your obligations

By transacting with us you consent to identity verification as required under the Wwft. For cumulative transactions above €10,000 you are required to provide a valid government-issued photo ID and, for business buyers, a recent KvK extract.

Reporting obligations

We are legally required to report unusual transactions to the Financial Intelligence Unit Netherlands (FIU-Nederland). This is a statutory obligation and not a reflection on the integrity of any individual buyer.

Record retention

All identity documents and transaction records are retained for a minimum of 5 years in compliance with Wwft requirements.

Right to decline

We reserve the right to decline any transaction where we cannot complete identity verification to our satisfaction or where we have concerns about the origin of funds.

We purchase gold and silver Krugerrand coins and gold from private sellers across the Netherlands and EU. All purchases by us are subject to Wwft identity verification of the seller, physical authentication and verification of the goods, and prevailing LBMA market rates at the time of transaction. We reserve the right to decline to purchase any goods without being required to give reasons. We pay all sellers exclusively by SEPA bank transfer. Cash payments to sellers above €3,000 are prohibited by law.

Ownership of goods passes to you only upon receipt of full cleared payment. Until that point all goods remain the property of GoldMarc B.V. You may not pledge, charge, or otherwise deal with goods that remain our property.

We are not liable for losses arising from precious metals market price movements after your order is placed; indirect or consequential losses of any kind including loss of profit or opportunity; delays caused by circumstances beyond our reasonable control; or losses resulting from incorrect payment references provided by you. Where we are liable, our total liability is limited to the value of the goods covered by the relevant Order.

We may suspend or cancel our obligations without liability in circumstances beyond our reasonable control, including armed conflict, pandemic, natural disaster, government restriction, transport disruption, supply shortage, or market disruption causing a price movement of 3% or more in a single trading session. Orders placed outside normal trading hours — weekdays before 09:00 and after 17:00 CET, weekends, and Dutch public holidays — may be cancelled without liability if market conditions change materially during that period. We will notify you by email no later than 12:00 on the next business day.

Where a payment arrangement has been agreed in writing and payment is not made on time, you are automatically in default. Statutory interest under Article 6:119 of the Dutch Civil Code plus 2% per month applies to the outstanding amount. All reasonable costs we incur in recovering overdue amounts, including collection agency fees, are payable by you. Extrajudicial collection costs are charged at a minimum of 15% of the outstanding amount with a floor of €250.

We handle your personal data in accordance with GDPR and Dutch privacy law. Data you provide is used for order fulfilment, Wwft compliance, invoicing, and where you have consented, marketing updates. We retain transaction records for a minimum of 5 years under Wwft and 7 years under Dutch tax law. You have the right to access, correct, or request deletion of your data at any time by contacting sales@goldmarc.nl. We will never sell your personal data to any third party.

If you believe your order has been incorrectly fulfilled or is incomplete, contact us in writing at sales@goldmarc.nl within 48 hours of receiving your goods. We will respond within 2 business days. Where a complaint is upheld, we will at our discretion replace the goods, supply any shortfall, or issue a credit. You may not withhold or suspend payment on the basis of an unresolved complaint.

These Terms of Trade are governed by Dutch law. We will always try to resolve any disagreement directly and in good faith before any formal process is considered. Where a dispute cannot be resolved between us, the competent court in The Hague, Netherlands, has exclusive jurisdiction.

If any part of these Terms of Trade is found to be invalid or unenforceable, the remaining terms continue in full force. Any invalid term will be replaced by the nearest valid equivalent. These Terms are published at goldmarc.nl/terms and provided to you at the time of each order.
